Stallion Service Contract
This agreement is made this ______ day of ______________, 2005 between __________________________ "Mare Owner" and Larry and Susan Wagner"Breeder."
The Mare Owner agrees to breed "The Mare" _______________________ Registration Number _____________ to the "Stallion" John Is Gone Registration Number (3247672) for the 2005 breeding season for the Stallion Service Fee of $400.00 which includes a nonrefundable booking fee of $100.00 payable upon execution of the agreement and to be applied to the total breeding fee. A copy of the mare's registration papers must accompany the booking fee and signed contract.
The Mare Owner agrees to pay Bar 1300 Quarter Horses the stallion service fee, veterinary expenses and all other expenses incurred during the stay. All board, farrier, veterinary and related expenses will be payable to Bar 1300 monthly. The balance of the stallion service fee and remaining board/veterinary/related expenses will be due prior to or at the time of departure. The mare will be released to the owner when all expenses have been paid in full. Any unpaid fees and expenses shall bear interest at 18% per annum until paid in full. Mare Owner agrees to pay all costs of collection including charges, expenses, attorney fees and related costs incurred in collection of balance. The Mare Owner grants Bar 1300 and the Stallion Owner entitlement to offspring and all registration papers and documents until charges are paid in full.
The Mare Owner agrees to allow necessary veterinary exams and services for reproductive and general health of the mare at the owner’s expense. Proof of current deworming and coggins (within past 6 months) are required upon arrival or will be performed at owner's expense. West Nile and rabies vaccinations are highly recommended, but not required. However, if not done, the mare owner releases Bar 1300 and the stallion owner from any and all liability associated with the lack of these two vaccinations. The Mare Owner is encouraged to provide to us any breeding history.
Bar 1300 agrees to diligently try to settle the mare provided we are given ample time and opportunity. The mare must be halter broke, healthy/free from infectious, contagious or transmissible disease and in sound breeding condition. Breeder reserves the right to refuse the mare if not in satisfactory condition. If refused, the booking fee constitutes liquidated damages. Bar 1300 shall not be responsible for infertility of the mare precluding conception, nor for illness, injury or death of the mare or offspring. The Mare Owner will not be responsible for illness, injury or death of the stallion arising from breeding. Nor will the stallion owner be responsible for illness, injury or death of the mare or offspring. Insurance of the mare and offspring is the sole responsibility of the Mare Owner. Authorization is granted to Bar 1300 to provide any and all emergency treatment at the owner's expense until the Mare Owner or emergency contact can be reached.
A Live Foal Guarantee will be granted subject to terms of this contract: 1) providing the mare is checked in foal prior to departure or at 14 days from last breeding date and veterinary statement sent to breeder; 2) rechecked at approximately 60 days gestation; 3) Rhino vaccinations (Prodigy or Pnuemabort-K) are given at 5, 7 and 9 months of gestation; 4) birth was attended; 5) mare may not return to race or performance training after checked in foal. Live Foal Guarantee "is defined as a foal resulting from the breeding stands and nurses after birth unassisted". The Mare Owner will be required to give notification of foal loss within 48 hours, followed by a veterinary statement of the loss within ten days. The Mare Owner may obtain the rebreed with payment of the booking fee, chute fee, board, veterinary and related expenses. The Breeding Fee less the booking fee and chute fee and related expenses may be refunded in lieu of a rebreed at the stallion owner's discretion. A breeder's certificate will be sent to the Mare Owner upon notification of the birth of a foal. This guarantee becomes null and void if the above listed conditions are not met.
At the option of the Stallion Owner, 1) if the stallion on this contract dies, is sold, transferred or becomes unfit or incapable of servicing mares prior to service, then this contract becomes null and void and the stallion service fee will be refunded and parties to the agreement are released from liability. 2) if the mare named above becomes unfit to breed prior to service, then this contract becomes null and void and the stallion service fee less the booking fee shall be refunded and parties to the agreement are released from liability, or another mare may be accepted in lieu. The mare owner will remain responsible for expenses incurred on behalf of the mare owner and are payable to the breeder. Wisconsin law governs this agreement, all of the terms and provisions of which are performable in Dunn County, Wisconsin. The parties agree that any legal action brought under this agreement or pertaining to the subject matter of this agreement can only be brought in Dunn County, Wisconsin.
Any deviation from the above terms and conditions must be put in writing, signed by Breeder and Mare Owner and attached to contract.
I agree on this date ____________________, 2005, to breed this mare ___________________________ to John Is Gone (stallion) for the 2005 season according to the terms and conditions stated in this contract. Upon signing, this contract is legal and binding and subject to contract terms and is non-transferable and non-assignable.
